Terms of Service

These Terms govern access to OpusImg's website, browser tools, accounts, paid plans, server processing, and APIs.

1. Acceptance

By accessing or using OpusImg (the “Service”), you agree to these Terms of Service and acknowledge our Privacy Policy. If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 16 and legally able to enter this agreement. You must provide accurate account information, keep credentials and sign-in links secure, and notify us promptly of suspected unauthorised use. You are responsible for activity under your account unless applicable law provides otherwise.

3. The Service

OpusImg provides tools that run locally in the browser and tools that upload content for storage or server-side processing. Each tool identifies its processing mode at intake. Features, supported formats, limits, and availability may differ by plan and may change as described in section 11.

4. Acceptable use

You agree not to:

  • Upload, process, or generate content that is unlawful, infringes rights, or that you do not have permission to use.
  • Create deceptive impersonations or non-consensual intimate content, exploit children, facilitate fraud, or evade safety controls.
  • Probe or disrupt the Service, distribute malware, access another person’s account or content, or bypass authentication, quotas, credits, or rate limits.
  • Scrape or reverse engineer the Service except where applicable law expressly permits it despite this restriction.

We may use automated safeguards, review reported activity, remove content, restrict processing, or suspend access when reasonably necessary to enforce these Terms, protect users, or comply with law.

5. Your content and privacy

You retain all ownership of the images and files you upload or create (“Your Content”). You grant us a limited license to host, process, and transmit Your Content only as needed to provide, secure, and support the Service, comply with your instructions, and meet legal obligations. This license ends when the relevant content is deleted from our active systems, subject to backup, security, and legal-retention periods described in the Privacy Policy.

You represent that you have the rights and permissions needed for Your Content and our processing of it. We do not use Your Content to train machine-learning models. Our Privacy Policy explains local processing, server uploads, providers, retention, and privacy choices.

6. Plans, credits, trials, and billing

  • Current prices, billing intervals, plan limits, and included credits are shown before checkout. Taxes may be added where required.
  • Paid subscriptions are charged in advance through Lemon Squeezy, our merchant of record, and automatically renew for the selected monthly or yearly interval until cancelled.
  • You can request cancellation through billing settings. Unless law or the checkout terms say otherwise, cancellation takes effect at the end of the paid interval.
  • Our published refund policy currently permits a full refund requested within 14 days of a charge and a pro-rata refund for an annual plan after that period. Any non-waivable statutory refund or withdrawal right also applies.
  • Credits, trials, and quotas are usage entitlements, not stored money. Their allowance, rollover, expiry, and cost are shown in the product or pricing page. They cannot be transferred or redeemed for cash.

7. AI features and outputs

AI features can produce incomplete, inaccurate, or unexpected results and may not preserve every detail. Outputs are not guaranteed to be unique. Review outputs before relying on or publishing them, especially for identity, legal, medical, safety, or compliance-sensitive uses. You remain responsible for your use of inputs and outputs and for respecting applicable law and third-party rights.

8. OpusImg intellectual property

The Service, software, interface, templates, documentation, and marks are owned by OpusImg or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service. No right to our names, logos, source code, or other intellectual property is granted except as expressly stated.

9. Third-party services

The Service relies on or may link to third-party services, including payment, storage, authentication, email, monitoring, analytics, AI processing, and OpusPDF. Their own terms and privacy notices may apply when you interact with them. A link or integration does not make OpusImg responsible for a third party’s independent service.

10. Suspension and termination

You may stop using the Service at any time and may cancel a paid subscription as described above. We may suspend or terminate access when reasonably necessary for a material or repeated breach, security risk, fraud, non-payment, legal requirement, or harm to the Service or others. Where practical, we will give notice and an opportunity to cure. Sections intended by their nature to survive will remain in effect.

11. Changes to the Service or these Terms

We may improve, replace, or discontinue features. We will provide reasonable notice when a material change adversely affects a paid plan, unless urgent security, legal, or operational reasons make advance notice impracticable. Material Terms changes apply prospectively from the stated effective date. If you do not agree, you may stop using the Service and cancel before the change takes effect.

12. Warranties and consumer rights

The Service is provided “as is” and “as available” without implied warranties to the fullest extent applicable law permits. We do not promise uninterrupted or error-free operation. Nothing in these Terms excludes a warranty, remedy, legal guarantee, withdrawal right, or other consumer protection that cannot lawfully be excluded or limited.

13. Limitation of liability

To the maximum extent permitted by law, OpusImg is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. For claims arising from a paid Service, our aggregate liability is limited to the greater of US $100 or the fees you paid for that Service during the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that cannot legally be limited. They also do not reduce mandatory consumer remedies.

14. Business-user indemnity

If you use the Service on behalf of a business, that business will defend and indemnify OpusImg against a third-party claim caused by its unlawful use of the Service, Your Content, or its material breach of these Terms, to the extent permitted by law. This section does not apply to an individual using the Service as a consumer.

15. Disputes and applicable law

Contact legal@opusimg.com first so we can try to resolve a dispute informally. These Terms and any dispute are subject to the law and courts that have jurisdiction under applicable conflict-of-law and consumer protection rules. Nothing here deprives a consumer of mandatory rights or access to a court or regulator available under the law where they live.

16. General

These Terms, the Privacy Policy, the checkout terms, and any plan-specific written agreement form the agreement for the Service. If a plan-specific signed agreement conflicts with these Terms, that agreement controls for the conflict. If a provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, reorganisation, financing, or sale of the relevant business, subject to applicable law.
